These Terms of Service (“Terms”) govern your access to and use of the Skinovatio Medical Spa – Ohio website (https://skinovatioohio.com/) (“Site”) and any services provided by Skinovatio Medical Spa (“we,” “us,” “our,” or the “Practice”) in the State of Ohio. By using our Site or requesting any service, you agree to be bound by these Terms, our Privacy Policy, and our HIPAA Notice of Privacy Practices.
If you do not agree to all of these Terms, you must not use our Site or services.
The content on this Site, including text, graphics, images, and information, is provided for general informational purposes only and does not constitute medical advice.
DO NOT USE THIS SITE FOR MEDICAL EMERGENCIES. If you believe you are experiencing a medical emergency, call 911 immediately. Reliance on any information on this Site is solely at your own risk.
A physician‑patient relationship is formed only after you have completed an in‑person or telehealth consultation with a licensed physician at our facility who determines that a proposed treatment is appropriate for you.
No Guarantee of Results: The Practice does not guarantee any specific outcome from any treatment or service. Individual results may vary based on numerous factors, including your unique anatomy, health history, and adherence to after‑care instructions.
Skinovatio Medical Spa provides medical spa services under the supervision of a licensed physician as required by Ohio Revised Code (ORC) Chapters 4731 and 4730 and rules of the State Medical Board of Ohio. All medical services, including injectables, laser/energy‑based treatments, microneedling, and IV therapy, are performed or directly supervised by a physician or an advanced practice provider acting under a written supervision agreement.
Medical records are maintained and retained in accordance with Ohio law (Ohio Administrative Code (OAC) 3701‑83‑11), typically for six years from the last date of discharge.
Before any medical procedure, we will obtain your written informed consent in separate, treatment‑specific forms as required by OAC 3701‑84‑07(2) and ORC §2317.54.
All advertising and marketing materials, including those on this Site, are truthful and not misleading. We do not make false, deceptive, or unsubstantiated claims about our services. The content of our advertising is reviewed and approved by a designated, qualified professional.
We comply with the Ohio Consumer Sales Practices Act (ORC Chapter 1345) and the Medical Board’s prohibition against false, fraudulent, deceptive, or misleading statements (ORC §4731.22(B)(5)). We never offer to waive patient copayments or deductibles, nor do we make claims about incurable diseases.
In any advertising that includes the name of a supervising physician, that physician’s full name and licensure status will be clearly disclosed.
Skinovatio Medical Spa does not pay or receive any referral fee, kickback, or rebate for the referral of a patient. We comply fully with ORC §3999.22 and the federal Anti‑Kickback Statute and Stark Law.
All medical spa procedures require your written informed consent after you have been informed of the nature, purpose, risks (both known and reasonably foreseeable), expected benefits, and alternatives to the procedure. You have the right to refuse or withdraw consent at any time. Refusal or withdrawal of consent will not affect your future care.
Your signed consent form will be maintained in your medical record.
If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials. You must not share, assign, or transfer your account to any other person. We reserve the right to suspend or terminate any account if we suspect unauthorized use or violation of these Terms.
We do not knowingly collect personal data from persons under the age of 18 (the age of majority in Ohio) without verifiable parental consent. If we discover that we have collected such data, we will delete it immediately.
You agree to provide complete, accurate, and current health information to the Practice, including all known medical conditions, allergies, medications (prescription and over‑the‑counter), and any previous treatments or surgeries relevant to the services you seek. Failure to disclose material health information may affect the safety and appropriateness of your treatment, and the Practice reserves the right to modify or cancel your treatment based on undisclosed information.
If you participate in a telehealth (virtual) consultation with the Practice, you acknowledge and agree that: (a) you must be physically located in the State of Ohio at the time of the telehealth visit; (b) telehealth has potential benefits and risks, which will be explained in a separate telehealth consent form; and (c) not all medical conditions can be appropriately diagnosed or treated via telehealth, and the provider may determine that an in‑person visit is necessary.
Our Site may contain links to third‑party websites or services (“Linked Sites”). These links are provided for convenience only, and we do not endorse, control, or assume any responsibility for the content, privacy practices, or terms of use of any Linked Site. Linked Sites have their own terms of service and privacy policies, and we have no liability for them.
All content on this Site, including but not limited to text, graphics, logos, images, software, and any other material, is the property of Skinovatio Medical Spa or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view and print content for your personal, non‑commercial use only. Any other use, including reproduction, distribution, modification, or republication, without our prior written permission, is strictly prohibited.
The Practice may take photographs or videos of treatment areas for medical records, quality assessment, or educational purposes. Any use of your image for marketing, advertising, or publication in any medium will only occur after we obtain your separate, written consent (a “Photo Release”). You are never required to sign a Photo Release as a condition of receiving treatment. Patient testimonials posted on the Site are obtained with prior written consent and reflect individual experiences; they do not constitute a guarantee of similar results.

TO THE MAXIMUM EXTENT PERMITTED BY OHIO LAW, IN NO EVENT SHALL SKINOVATIO MEDICAL SPA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Skinovatio Medical Spa, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) your violation of these Terms; (ii) your use of the Site or services; or (iii) your violation of any applicable law or the rights of any third party.
We reserve the right to modify or replace these Terms at any time. If a material change is made, we will provide notice by posting the updated Terms on this page with a new “Last Updated” date. It is your responsibility to review these Terms periodically. Your continued use of the Site or services after any changes indicates your acceptance of the revised Terms.
(a) Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of laws principles.
(b) Venue: Any legal action or proceeding arising out of or relating to these Terms or your use of the Site or services shall be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio. You consent to the personal jurisdiction of those courts.
(c) Binding Arbitration (Optional): At our sole discretion, any dispute, claim, or controversy arising out of or relating to these Terms or the services provided (except claims for injunctive or equitable relief) may be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration shall take place in Cuyahoga County, Ohio, and judgment on the award may be entered in any court having jurisdiction.
(d) Class Action Waiver: To the fullest extent permitted by law, you agree that any proceeding to resolve a dispute will be conducted only on an individual basis and not as a class, consolidated, or representative action.
This Site and the services described are operated in compliance with all applicable rules and regulations of the State Medical Board of Ohio, the Ohio Board of Nursing, and the Ohio Board of Pharmacy. We adhere to all scope‑of‑practice, delegation, supervision, and recordkeeping requirements.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
